Apple Wants $40 from Samsung for Every Smartphone Sold

      Apple wants to seek US$40 for every smartphone Samsung has sold as compensation for patent infringement, the Foss Patents blog reported.

      In an upcoming trial, Apple will claim it deserves $8 for each of the five patents Samsung allegedly copied without permission. The patents include auto-complete text, voice-activated search and swipe functions. A Samsung spokesman said Apple's iPhone and iPad also infringe on two of the Korean company's patents: digital and voice data transmission and remote video transmission technologies.

      Florian Mueller, who writes the Foss Patents blog, said, "Apple's damages theory for the trial that will begin in less than three weeks (on March 31) is an objective insanity."

      He added, "$40 per unit. For five software patents. Give me a break." Mueller said there were past cases where a compensatory payment of $8 per smartphone was levied, but paying that amount for each patent infringement would make royalties for the patented technology more expensive than the actual device.
