The 13th Civil Department of the Southern Seoul District Court has turned down a lawsuit that was filed by a certain 43-year-old Mr. Park of Osan, Gyeonggi Province against D insurance company, with which a policy was registered by his wife Ms. Yoon, to grant insurance money worth W150 million.
He asserted that his wife, in a reckless state of mind following a husband-and-wife spat, jumped from the terrace of a 12-story apartment building and was killed. In the written judgment the bench said, "In case of someone intentionally damaging oneself such as suicide and self-injury, an insurance company does not have any obligation to grant insurance money, based on their own stipulations... Although Park asserted that it cannot be regarded as an intentional incident because his wife jumped in a reckless state of mind, there are no reasons that can support his claim."
As Park quarreled with his wife Yoon over the problems of setting his business warrantee on his apartment terrace in October 2003, Yoon jumped from the 12 story high terrace and was killed. Though Park demanded that D insurance company, to which his wife has subscribed, grant the insurance money, the company gave only the insurance fee that had been paid by his wife so far -- W3,460,000.
