The Munich Regional Court on Wednesday rejected an application from Apple to ban the sale in Germany of Samsung Electronics' Galaxy 10.1N tablet PC and Galaxy Nexus smartphone. Apple filed for an injunction last year claiming Samsung infringed its touch-screen technology patent.
"Samsung has shown that it is more likely than not that the patent will be revoked because of a technology that was already on the market before the intellectual property had been filed for protection," judge Andreas Mueller said.
After another regional court in Germany banned the Galaxy Tab 10.1 last September, Samsung released the Galaxy Tab 10.1N with a slightly more different design from Apple's. Afterwards, Apple asked the Munich and Dusseldorf regional courts to ban the Galaxy Tab 10.1N as well.
